Someone bought pretty much everything in my apt. dishes, silverware, sofa, flat panel tv, furniture (bed, desk, coffee and end tables), lamps playstation 3, and now they are mad at me. they claim they have receipts for all of it but i know they don’t have the receipts for some stuff, and threaten to bring the sherrif and take it all back b/c they are mad at me. i have always heard possetion is nine tenths of the law, if so they can’t take my things, at least not before a court ruling right?
They furnished my apt as a nicety to me. they told me they didn’t want me to work because i am in school and they wanted me to do well. now i have made them angry and they want the things back, but they have been in my apartment for over 6 months, most of it anyway, and all of them were bought for me as gifts… i have friends that can testify the things have been here forever and the dates on the receipts will speak for themselves. the things were bought for me, have been maintained by me, and are in my apartment. I am the only name on the lease and these items did not belong to a former roommate, i pulled the plastic off of all of it.

If they have the proof that they purchased the items then yes they can. Sounds like you have angered a woman!

They would not be able to take it from you without a lawsuit. This is because you don’t have to let them into your apartment if you don’t want to. They can call the cops, but the cops won’t do anything without proof that the items in your apartment belong to this other person.
What this other person can do is file a lawsuit, most likely in small claims court. You will both go before a judge. The other person will claim that he or she loaned you these things, and you will claim that he or she gave you these things. Most likely you will win, if there was no written agreement for a loan.

If they have proof that they bought it, reliable reciepts with reliable dates, then in a court of law I don’t think they’d get in trouble. If they went to your apartment in the middle of the night and stole it, that’s illegal repossession, that would get them in trouble. If they gave you warning and showed up at your house with police and proof of purchase, it would be a waste to argue with them.

not enough info. If the stuff was a gift, it is yours. If that person was a roommate and you are holding his/her stuff, get ready for the sheriff.

You’re totally leaving something out. How is it in your apartment if someone else bought it? Was it a gift? Was it left behind when the owner moved?
Whether or not they can legally get the property back depends entirely on how you acquired it. More information is definitely needed.

If your name is on the lease, change the locks so he can not get in. Then if he wants the stuff back, he will either have to break in and steal it, in which case you get him for breaking and entering and theft OR he will have to get a court order. To do that, he will have to provide the “proof” that he says he has.
But if the lease is in his name, be glad he is not kicking you out on your butt.
Just as an aside, it sounds like you had a sugar daddy and now he is not so sweet.
